摘要
中国特色社会主义检察制度,立足于我国的基本国情,是我国政治体制与司法体制的共同选择。2018年3月11日第五次《中华人民共和国宪法修正案》的正式通过,意味着我国国家权力的配置发生了重大变化。监察机关宪法地位的正式确立、以审判为中心的刑事诉讼制度改革的推进以及司法改革的深化,给新时代检察机关的职能配置带来了根本性、系统化的影响。检察机关作为宪法规定的法律监督机关,更加需要立足本职,重新审视其所具有的侦查职能、公诉职能和诉讼监督职能,使检察职能符合新时代检察工作的需求,为完善多元化检察职能体系奠定坚实的基础,为中国特色社会主义检察制度的发展提供方向。
Based on the fundamental realities of China,the procuratorial system of socialism with Chinese characteristics is the common choice between China’s political system and judicial system.The fifth"Amendment to the Constitution of the People’s Republic of China"was officially approved on March 11,2018,which is a significant change on the allocation of our state power.The procuratorate in new era is fundamentally and systematically impacted by 3 aspects:the formal status of supervisory organ established in constitution,the advancing of reform on the trial-centered criminal litigation system and the depended reform on administration of justice.As the legal supervision organ stipulated in the Constitution,the procuratorate is required to review its investigation function,public prosecution function and litigation supervision function,so that it can meet the needs of the procuratorial work timely,and consequently to lay a solid foundation for completing the diversified procuratorial function system and provide a direction for the development of the socialist procuratorial system with Chinese characteristics.
