摘要
残障人教育事业的发展离不开法律制度的推动。我国残障人教育制度从政策主导向依法治理、从单一福利型向权利与福利并重型转变。2017年修订的《中华人民共和国残疾人教育条例》以融合教育为理念,规定了国家、社会、学校、家庭的保障义务,完善了相关制度。但我国残障人教育法律体系尚未形成,责任机制不健全,原则性与程序性规定缺失。今后应以残障人教育的特殊性为基点,依据教育效能、教育自由、教育公平、教育效率的内在价值,完善残障人教育法律制度。
The development of education for the disabled is inseparable from the promotion of the legal system.China’s education system for the disabled has changed from policy-based to legal governance,from single welfare to rights and welfare.The Regulations of the People’s Republic of China on the Education of Disabled Persons,revised in 2017,adopts the concept of integrated education and stipulates the guarantee obligations of the state,society,schools and families,and improves the relevant systems.However,the legal system for the education of the disabled in China has not yet been formed,the responsibility mechanism is not perfect,and the principled and procedural provisions are missing.In the future,based on the particularity of education for the disabled,the legal system of education for the disabled should be improved based on the intrinsic value of educational efficacy,educational freedom,educational equity,and educational efficiency.
