摘要
基础教育办学中的法律纠纷是指在基础教育办学过程中,学校、教师、学生及其他社会主体等侵犯他人合法权益而产生的各类法律纠纷。依据纠纷主体不同,可分为学校与学生、学校与教师、学生与学生间的涉内纠纷,学校与行政部门、教师与行政部门、学校与社会间的涉外纠纷。基础教育办学中的法律纠纷的典型特征包括在主体上以涉内纠纷为主,在性质上以民事纠纷为主,在原因上以侵权纠纷为主,在标的上以非财产纠纷为主;其产生原因包括法律规范体系不健全、法治实施体系待改善等外部因素,以及相关主体法治素养不足、职业道德水平下滑等内部因素。对此,应通过完善法律规范体系、强化法治实施体系、推动依法治校、加强法治宣传教育、强化职业道德建设等举措予以有效应对。
Legal disputes in the running of basic education refer to all kinds of legal disputes arising from schools,teachers,students and other social entities infringing on the legitimate rights and interests of others in the process of running basic education.According to the different subjects of the dispute,it can be divided into two categories:internal disputes between schools and students,between schools and teachers,between students and students,and external disputes between schools and administrative departments,between teachers and administrative departments,and between schools and society.Typical characteristics of legal disputes include mainly internal disputes in terms of subject,mainly civil disputes in terms of nature,mainly infringement disputes in terms of causes,and mainly non-property disputes in terms of subject matter.The reasons for this include external factors such as the imperfect legal normative system and the need to improve the rule of law implementation system,as well as internal factors such as insufficient legal literacy and the decline of professional ethics.In this regard,we should effectively respond by improving the legal normative system,strengtbening the rule of law implementation system,promoting goverming schools according to law,strengthening publicity and education on the rule of law,and strengthening the construction of professional ethics.
