摘要
恶势力犯罪脱胎于原有的流氓罪,带有一定的"流氓行为"色彩。黑社会性质组织犯罪和恶势力犯罪是两种截然不同的犯罪类型,认定恶势力犯罪时应着重考察组织性要求、行为方式要求和行为结果要求。通过将恶势力团伙(集团)与黑社会性质组织具有的组织特征、经济特征、行为特征以及危害性特征进行对比分析,可以准确地对二者作出区分。对司法实践中认定恶势力犯罪的案件进行统计分析,能够发现2018年以来认定为恶势力犯罪的案件数量显著增长,而且恶势力犯罪的分解罪名与现有归纳高度一致。但是与此同时,也存在法院对恶势力犯罪的认定不够明确、部分案件中恶势力犯罪认定不当以及恶势力的认定主体错位等若干问题,需要在司法实务中不断予以完善。
Crimes committed by vicious power start with the crime of hooliganism,while there are distinct dif-ference between crimes committed by the underworld organization and by the vicious power.Therefore,the require-ments of organizing ways,behavioral patterns,and behavioral consequences should be emphatically investigated inthe definition of vicious power’s crimes.The difference between them can be accurately defined by comparing andanalyzing the characteristics in organization,economy,behavior,and damage.By the statistic analysis of the crimescommitted by vicious power in juridical practice,the identified crime cases of such group has been significantly in-creased since 2018,and separation accusations are highly consistent with the existing induction of vicious power’scrimes.However,some problems should be solved in juridical practices,such as ambiguous definition of viciouspower’s crimes made by the court,inappropriate definition of vicious power’s crimes in partial cases,and inverseposition of identified part of vicious power,etc.
