摘要
司法体制与监察体制改革时代背景下,检察建议的功能和作用随检察职能的变革而变化。把检察建议做成刚性、做到刚性成为当前检察机关面临的一个新课题。而检察建议要做到刚性,前提是先要在质量上做成刚性。质量是检察建议的生命线,也是检察建议刚性的支撑和保障。以社会治理类检察建议样本为切入点,以《人民检察院检察建议工作规定》在落实中存在的问题为导向,结合基层检察机关检察建议工作实践,参照最高检"一号检察建议"范本,探索出基层检察机关在质量上把检察建议做成刚性的有效路径,即通过格式规范、案件化办理、审核制度优化、专门部门集中办理等举措,促进检察建议内容规范、强化调查核实来助推文书质量的提升。
In the background of reform in the judicial system and the supervisory system,the functions and roles of procuratorial proposals have changed with procuratorial functions. It is a new mission for the procuratorates to promote the quality and rigidity of the procuratorial proposal. To realize the rigidity of the procuratorial proposal,its quality should first of all be guaranteed because quality is the lifeline,the basis and the guarantee of a piece of procuratorial proposal. Starting from the analysis on the procuratorial proposal concerning social governance,this paper will analyze the problems that local procuratorates facing during the implement of Provisions on Procuratorial Proposal,and take The No. 1 Procuratorial Proposal as the sample to seek the approach for the local procuratorate to normalize the procuratorial proposal. Such measures as norming the format,managing independently,reinforcing the audit procedure and building an exclusive department to write the proposals can contribute to the standardization of content and intensification of the investigation,thus improving the quality of procuratorial proposal.
