摘要刑事诉讼法中未成年人犯罪案件社会调查报告的适用在未成年犯罪人的量刑及教育改造中具有重要的作用。尽管我国刑事诉讼法及司法解释对社会调查的内容和开展调查的主体作出了规定,但是实践中社会调查报告的适用情况不甚乐观。由于立法上的模糊和过于原则,社会调查报告的适用流于形式化,难以发挥其应有的作用。为解决社会调查报告形式化的问题,应当对社会调查报告的法律地位、适用要求,社会调查的启动条件以及调查主体作出更加明确具体的法律规定。与此同时,要完善社会调查报告去形式化的配套措施,包括丰富社会调查报告的内容及形式、规范监督社会调查工作;同时,搭建社会调查报告网络数据共享平台,将其系统化、数据化、便利化,使社会调查报告在预防未成年人犯罪等方面的作用得到充分发挥。 It is of great importance that social investigation reports of juvenile delinquency cases can be used in the juvenile offender’s sentencing and education reform according to The Criminal Procedure Law.Although The Criminal Procedure Law of China and judicial interpretations stipulate the content of social investigations and the subject of investigations,the application of social investigation reports in practice is not very satisfactory.Because of the ambiguity and over-principle in legislation,the application of social investigation reports has been formalized,making it difficult to play its due role.In order to solve the problem of formalization of social investigation reports,the legal status of social investigation reports,the conditions for initiating social investigation reports,the applicable requirements of social investigation reports,and the subjects of investigations should be made clearer with more specific legal provisions.Meanwhile,it is necessary to improve the supporting measures for the de-formalization of social survey reports,including enriching the content and format of social survey reports,standardizing and supervising social survey work,and building a network data sharing platform for social survey reports to systematize,digitize,and facilitate social survey reports so that the social investigation report will be able to play a full role in preventing juvenile delinquency.
