摘要高校内部的集体决策存在一系列制度缺陷,行政机构的集体决策因决策参与者地位的式微导致不能充分汇集意见,学术委员会的集体决策被行政文化影响,因决策规则缺乏导致难以实现科学决策,因缺乏来自法律的监管导致高校内部决策不能实现法治化。高校内部集体决策存在缺陷源自于高校外部的管理体制,法律赋予了高校行政机构不能承受的集体决策权,法律的不到位导致高校内部集体决策规则缺乏,政府亲自办教育不利于高校内部决策的法治化进程。为此,应该根据公办高校的性质确定集体决策的参与者,建立内外结合、决策与执行分离的治理结构,通过立法制定高校内部决策程序,通过对高校依法监管实现高校内部集体决策的法治化。 There are a series of institutional defects in collective decision-making in colleges and universities.The collective decision-making of administrative organs is not sufficiently pooled because of the unequal status of decision-making participants.The collective decision-making of academic committees is affected by administrative culture.The lack of decision rules makes it difficult to make scientific decisions.The lack of supervision from law leads to the failure of legalization of internal decision-making.The defects of collective decision-making originate from the external management system.The law gives the administrative organs in colleges and universities an unacceptable collective decision-making power.The imperfection of law causes the lack of collective decision-making rules.The government’s direct involvement in education has hindered the process of legalization of internal decision-making in colleges and universities.Participants in collective decision-making should be determined according to the nature of public universities.An integration of internal-and-external governance structure should be established within which the decision-making and execution should be separated.Through legislation to formulate internal decision-making procedures and legal supervision of universities,the legalization of collective decision-making within universities can be realized.
