摘要
价值是习惯理论的重要部分,习惯的规范价值所指即是作为客体的习惯,之于主体需求的满足可能及实现途径。习惯的规范价值主要包括秩序、自由、正义。就秩序而言,习惯主要通过内部的义务性规则保障秩序得到实现,通过习惯的秩序主要呈现为一种“自生自发”的秩序形态。就自由而言,习惯主要通过内部的权利性规则保障自由得到实现,通过习惯的自由主要呈现为一种“消极”的自由形态。作为“价值的价值”,正义的存在使得关于习惯的价值分析能够超越习惯本身,返回到对习惯存在本身的合理性追问上去,这是正义之于习惯的最大价值之所在。
The theory of value is an important part of the theory of custom law.The normative value of custom law refers to the possibility and realization of custom law for the needs of the subject.The normative value of custom law mainly includes order,freedom,and justice.To the order,custom law is mainly realized through internal obligatory rules,and the order through custom law is mainly presented as a"spontaneous order".To the freedom,custom law is mainly realized through internal rights rules,and the freedom through custom law is mainly presented as a"negative freedom".As the"value of value",the existence of justice enables the value analysis of custom law to go beyond the normative and return to the question of the rationality of the existence of custom law.This is the greatest value of justice to custom law.
