摘要
学界普遍认为民间规范的识别就是民间规范的司法识别,因此学界仅研究了司法识别的标准,而未研究立法识别的标准。其实在立法场域立法者也需要对民间规范进行识别,以确定民间规范是否存在以及能否被立法运用。从语义上说,民间规范的立法识别也是可以成立的。立法者可以依据本体标准、场域标准和价值标准识别民间规范。
Scholars generally believe that the identification of folk norms is the judicial identification of folk norms,so the academic circles only study the standards of judicial identification,but do not study the standards of legislative identification.In fact,in the legislative field,legislators also need to identify folk norms to determine whether folk norms exist and whether they can be applied by legislation.Semantically speaking,the legislative identification of folk norms can also be established.Legislators can identify folk norms based on ontological standards,field standards,and value standards.
