摘要
为减少煤矿企业生产安全事故造成的人员伤亡和经济损失,新安全生产法鼓励生产经营单位投保安全生产责任保险。基于煤炭行业对安全生产责任保险的需求,通过文献分析法对煤炭行业安全生产责任保险的产生及发展过程进行分析论述,明确安全生产责任保险定义及内容,分析目前煤炭行业实施安全生产责任保险所面临的问题。结合我国现行法律法规,借鉴其他高危行业实施安全生产责任保险的工作经验,提出适用于煤炭行业的安全生产责任保险运行机制,并根据目前的运行现状分析解决问题的对策及建议,健全安全生产责任保险体系,充分发挥安全生产责任保险在煤矿企业中的事前预防及事后经济赔偿功能。
To reduce the losses caused by safety accidents in the coal mine industry,the new Work Safety Law puts forward that the coal mine and other high-risk industries should carry out liability insurance for safe production.The introduction of a commercial insurance model in the coal mine industry can enhance the ability of pre-prevention and economic compensation for safety production accidents.By consulting and sorting out relevant materials of liability insurance of safe production,summarizes the arising and development of liability insurance of safe production,expounds the main content of the liability insurance of safe production,points out the problems existing in the implementation of liability insurance of safe production in the coal mine industry,and puts forward solutions and suggestions to solve the problems.At the same time,it theoretically discusses and studies the liability insurance of safety production mechanisms suitable for China’s national conditions in the coal mine industry,expecting to promote the rapid development of liability insurance in the field of safe production.
