摘要
庭审话语不仅反映了庭审参与者的身份、地位、动机、态度等,而且能够建立和维护一定的人际关系,辩护话语在庭审中的作用更是不容忽视,它与被告人的判决等权益息息相关。以美国联邦最高法院30场庭审为语料,借助AntConc对庭审辩方立场标记语的类型进行划分和统计,探究辩方律师立场标记语的分布特征及其所实现的人际功能,关注律师是如何通过运用各类立场标记语来构建有利的叙事版本,维护良好的人际关系,保障当事人的合法权益,以期为庭审律师提供话语策略方面的借鉴。
Courtroom discourse can not only reflect participants’identity,status,motivation and attitude,but also can establish and maintain interpersonal relationships.The defense discourse is supposed to be attached to great importance,which is closely associated with the sentence and rights of the defendant.Therefore,based on 30 United States Supreme Court trials and supported by the Ant Conc to classify the types and count the number of the stance markers used by the defense attorney,this study endeavors to reveal the features of the stance markers and its interpersonal function of the defense discourse in the courtroom.Hopefully,it could shed light on the language strategy used by the attorney about how the defense use the stance markers to construct favorable narratives,maintain harmonious interpersonal relationships,and protect the legitimate rights and interests of the parties.
