摘要
笔者通过文献及现行法律梳理了草原承包经营制度的发展过程和现有的调整方式,即从草原的全民所有到草畜双承包制再到目前的“双权一制”。通过法律文件的对比,分析了目前“三权分置”下草原承包经营权法律体系的不足,具体包括对土地承包经营制度依赖较强没有突出草原特点、“三权分置”下草原承包经营权法律依据不足、地方立法滞后等问题;明确草原承包经营权法律体系的完善,形成以《民法典》为引领、以《草原法》为主干、以地方草原相关立法为主要内容的法律体系。
Based on literature and current law,the author reviews the development process and the existing adjustment methods of grassland-contracting system,that is,from the grassland collective ownership to the grassland-livestock dual contracting system and then to the current“two rights and one system”.Through the comparison of legal documents,the author analyzes the deficiencies of the current legal system on grassland-contracting right under the“separation of three rights”which include the strong dependence on the land-contracting system without highlighting the characteristics of grassland,the insufficient legal basis,the lagging local legislation and so on.Therefore,it is necessary to improve the legal system on grassland-contracting right with the Civil Code as the guide,Grassland Law as the focus,and local legislation as the main content.
