摘要
当前,美国明显将其对外经贸战略重心转向非多边主义,肆意践踏WTO多边主义规则,竭力促成包括《中美经贸协议》在内的非多边经贸协定。在非多边经贸协定范畴下比较研究《中美经贸协议》中的知识产权新规则,有助于理解其来龙去脉及特点,并由此梳理该协议所含美国确认其现行措施给予同等待遇的具体制度。研究非多边经贸协定下的知识产权新规则,与履行《中美经贸协议》知识产权条款的义务密不可分;同时,中国应在把握相关规则发展趋势时未雨绸缪,以应对今后更多挑战,并在建设知识产权强国过程中推进构建知识产权国际保护的人类命运共同体。
Currently,the United States is shifting its foreign economic and trade strategy to the non-multilateralism by violating the WTO multilateral rules and promoting the non-multilateral economic and trade agreements including the Sino-US Economic and Trade Agreement.The new rules of intellectual property under this Agreement should be compared with the non-multilateral category so as to understand its origin and characters and to analyze the systems relating to the United States’promises to afford equivalent treatments by its existing measures in accordance with the provisions of intellectual property and technology transfer under this Agreement.It is highly relevant to study the new non-multilateral rules of intellectual property for implementing the obligations under the intellectual property provisions of the Sino-US Economic and Trade Agreement,and while building a nation with a strong intellectual property,China should prepare responses to more challenges ahead by grasping the trend of the new rules and constructing the human community with a shared future for international protection of intellectual property.
