摘要
通过分析一起张某某使用伪造《医师资格证书》《医师执业证书》在正规医疗机构内开展诊疗活动案,探讨在当事人否认的情况下,如何搜集证据证实违法行为、如何认定违法所得,并分享公安机关关于使用假证违法行为的认定,以期对查处同类案件有所参考。
The litigantof this case, Zhang XX, used fake "Physician Qualification Certificate" and "Physician Practice Certificate" to carry out diagnosis and treatment activities in formal medical institutions. The casewas complicated and difficult to obtain evidence. Through case analysis, this paper discussed how to collect evidence to confirm the illegal behavior, how to identitifythe illegal income, and how to share the public security organ’s identification of the illegal act of using fake certificate, hoping to have some reference for the investigation and handling of similar cases.
