摘要
民生问题不仅是政治问题,更是法律问题。通过对辽宁省民生保障立法进行梳理可以发现,辽宁省民生法制体系框架已基本成型,民生保障立法的七大主要议题几近实现全覆盖。但进一步对社会救助、养老保障、生育保障和就业保障等四类民生重点领域的立法进行考察可知,辽宁省民生法制还存在立法阙如、重点领域立法缺位与法规可操作性不强等不足。辽宁省民生保障立法可从三方面进行完善:以地方特色为切入点加强立法创新;以实际需求为导向填补立法空白;以精细化立法为原则提升法规的实操性。以此实现辽宁省民生保障地方立法的创新发展,实现辽宁省民生保障的有序推进,并助力辽宁经济有力振兴。
People's livelihood is not only a poltical issue,but also a legal issue.By sorting out and studying the livelihood legislation in Liaoning Province,we can find that the legal framework for the livelihood of Liaoning Province has basically taken shape,which has all covered the seven aspects.However,further investigation on legislation in four key areas of people's livelihood,such as social assistance,old-age security,maternity security and employment security,shows that there are still deficiencies in Liaoning's people's livelihood legal system,such as lack of original legislation,absence of legislation in key areas and weak operability of laws and regulations.The legislation of livelihood security in Liaoning Province can be improved from three aspects:strengthening legislative innovation with local characteristics;Fill in the legislative gaps with the guidance of actual needs;Improve the practicality of laws and regulations based on the principle of fine legislation.In this way,the innovation and development of local legislation for ensuring the people's livelihood in Liaoning Province can be realized,and the orderly promotion of the people's livelihood in Liaoning Province can be realized,and help to vigorously revitalize the economy of Liaoning Province.
