摘要
长三角港航一体化在长三角高质量一体化中的地位至关重要,而长三角港航一体化的实现绕不开央地关系这一命题,尤其是诸多垂直领导部门的配合对相关工作至关重要。但是,现实中垂直领导部门经常因其垂直领导的性质和现有制度的束缚,难以积极回应长三角高质量一体化的地方需求,有时甚至会起阻碍作用,形成了长三角港航一体化的央地关系制度悖论。浙江自贸试验区在制度创新过程中,为该制度悖论提供了典型事例和集中体现。该制度悖论的根本成因在于现行制度体系缺乏有效的制度供给,不能促进“地方需求”与“垂直领导”之间的高效协作。对此,应以“事权法治制度一体化”的方略,以“三大清单”为路径,提供有效制度供给,促进中央和地方的良性联动。
Yangzi River Delta Harbor&Shipping integration plays an important role in the Yangzi River Delta integration.Central-Local relationship is deeply involved in Yangzi River Delta Harbor&Shipping integration.One of the key aspects is the attendance and cooperation of vertical-leading departments.However,in practice,“Vertical Leadership”frequently leads to the result that vertical-leading departments may not be able to cooperate with the local demand of Yangzi River Delta integration.Additionally,sometimes they may even do harm to local demands,which constitutes the Legal Paradox of Central-Local Relationship in Yangzi River Delta Harbor&Shipping integration.The legal innovation of Zhejiang PFTZ is a typical example,and the supply of bonded fuel in Zhoushan in Zhejiang PFTZ construction is a comprehensive appearance of such situation.The basic reason which leads to such paradox is that current legal system is not able to provide effective and steady cooperation system between local demand and vertical leadership.To solve such problem,the strategy of“power-rule of law-system-incorporation”should be adopted,“Three Lists”should be made,so that effective legal supply will be made,so that“Central-Local-Reaction”will be improved.
