摘要
生物基因编辑技术尤其是人类基因编辑技术是一项划时代、具有革命性意义的生物技术,但是其还有不可忽视的生物风险、伦理风险、社会风险和法律风险。如果对该技术运用不当将对人类及子孙后代造成不可逆转的巨大伤害。因其重要性和特殊性,人类基因编辑技术在国际上一直受到广泛关注,许多国家虽对其立法但在立法上的容忍度不同。自2018年贺建奎基因编辑事件之后,人类基因编辑技术在国际上的讨论又一度掀起热潮,国内外大部分学者都对人类基因编辑技术在临床上的应用持反对态度。为维护国家的生物安全和社会伦理,真正与《中华人民共和国民法典》《中华人民共和国生物安全法》相衔接,《中华人民共和国刑法修正案(十一)》明确了非法基因编辑应承担的法律责任。对人类基因编辑技术进行刑法规制具有必要性和重要性,有助于人类基因编辑技术的立法完善。
Biological gene editing technology,especially human gene editing technology,is an epoch-making and revolutionary biotechnology,but it also has technical and ethical risks that can not be ignored.If this technology is not used properly,it will cause irreversible and great harm to mankind and future generations.Because of its importance and particularity,human gene editing technology has been widely concerned in the world.Although many countries legislate on it,their tolerance in legislation is different.Since He Jiankui’s gene editing event in 2018,the discussion of human gene editing technology has once again set off an upsurge all over the world.The majority of domestic and foreign scholars are opposed to the clinical application of human gene editing technology.Amendment(XI)to Criminal Law of the People’s Republic of China(PRC)has defined the legal responsibilities of illegal gene editors,in order to safeguard the state’s biological safety and social ethics,and connect with the"Civil Code of PRC"and"Biosafety Law of PRC".Through the analysis of biological,ethical,social and legal risks of human gene editing technology,this paper puts forward the necessity and importance of criminal regulation of human gene editing technology,in order to contribute to the legislation of human gene editing technology.
