摘要
随着中国仲裁融入世界的步伐不断加快,我国对境外仲裁机构在中国内地开展业务逐渐开放,由此而衍生出来的一些法律问题亟待深入探索。仲裁裁决的国籍关乎裁决如何得以执行,因而如何认定仲裁裁决的国籍十分重要。我国对境外仲裁机构在中国内地裁决的国籍认定标准仍有不完善之处,在立法层面上仍未有明确规定。虽然《中华人民共和国仲裁法(修订)(征求意见稿)》规定了仲裁地标准,但其尚未生效,在司法实践层面上仅以案例的形式明确了仲裁地标准。因此,我国仍需明确并完善以仲裁地为标准认定境外仲裁机构在中国内地裁决的国籍,推动我国仲裁市场的进一步开放,提升我国仲裁公信力。
With the establishment of the Free Trade Pilot Zone and the implementation of the“Belt and Road Initiative”,China’s arbitration practice has evolved along with China’s economic development since 2015.More and more overseas arbitration institutions are expected to set up branches and conduct arbitration practice in China.Some issues relating to these overseas arbitration institutions need more attention.The significance of the nationality of an arbitration award is that it represents the source of the authenticity of its legal effect.The determination of nationality,therefore,how to identify the nationality of arbitration award made by overseas arbitration institutions in China’s mainland is of great importance.China’s law has no solid standard of the nationality of a foreign arbitration award.Even though the Arbitration Law(Revision Draft)has adopted the seat of arbitration standard,it is still a draft which has no legal force.Therefore,China should adopt the seat of arbitration standard especially for overseas arbitration institutions.It will,apparently,enhance Chinese arbitration credibility further.
