摘要
为提升我国铁路安全监管效能,规范铁路安全监管行为,保障铁路安全运营,从铁路安全监管体系、铁路领域立法、执法队伍建设等方面分别研究我国、美国、日本等铁路安全监管现状;在分析我国铁路安全监管问题成因和国外铁路政府监管先进经验的基础上,提出健全铁路安全法规体系、建立科学的监管体系、加大事故调查追责力度等建议。结果表明:我国铁路安全监管存在法规滞后、体系不协调、履职效能不高等问题;国外铁路通过立法,建立起较完善的监管体系,在安全监管方面取得了实践效果;借鉴国外经验有助于提高我国铁路安全监管水平。
In order to improve the efficiency of China’s railway safety supervision,standardize the railway safety supervision behaviors and ensures the railway safety operation,status quo of railway safety supervision in China,the United States and Japan were studied from aspects of railway safety supervision system,railway legislation,law enforcement team construction and so on.Based on analysis of causes of China’s railway safety supervision problems and the advanced experience abroad,suggestions such as improved the railway safety regulation system,established a scientific supervision system,increased the intensity of accident investigation and accounted was put forward.The results show that there are some problems in our railway safety supervision such as lagging regulations,uncoordinated systems,and low performance efficiency and so on.While foreign railways have established a relatively complete supervision system and achieved practical results in safety supervision through legislation.Learning from foreign experience is helpful to improve China’s railway safety supervision level.
