摘要
我国标准化法律体系由标准化法、标准化特别法、标准化配套法规规章、行业标准化规章、地方标准化法规规章和其他标准化规范性文件构成。2017年《标准化法》修订,对标准体系和标准化制度作了新的规定,然而由于其他标准化立法未能及时跟进,导致标准化法律体系出现诸多不协调和配套制度缺失问题。本文建议应当加强标准化立法规划,严格遵照新《标准化法》的规定,加快有关法律法规规章的制修订工作,健全和完善标准化法律体系,为国家实施标准化战略、实现国家治理现代化提供法制保障。
China’s standardization legal system is composed of Standardization Law of China and other laws on standardization,standardization regulations,local legislation and other normative documents on standardization.In 2017,the Standardization Law of China was revised to make new rules on the standardization system.However,many problems emerged as the relating standardization legislation is not revised in time,such as the lack of coordination and supporting systems to the Standardization Law of China.The standardization legislation planning shall be strengthened,and the development and revision of relevant laws,regulations and rules shall be accelerated by strictly abiding by the provisions of the revised Standardization Law of China to improve the legal system of standardization,and provide legal guarantee for the implementation of standardization strategy and the modernization of national governance.
