摘要
网络犯罪的高发态势以及电子数据法律规范的发展,对法律人电子数据审查能力提出了新的要求,时间要素则为电子数据的真实性审查提供了有效的切入口。电子数据的时间审查以传统时间要素原理及系统性原理作为基础,以证据审查矛盾律为方法指导,并对电子痕迹理论进行了创新。电子数据的时间信息一方面来源于其本体形式中的附属信息时间、网络多节点时间、全盘时间线以及电子数据的自然映射时间;另一方面来源于其拓展形式中的文书记载时间、截图反映时间、光盘中时间信息以及电子版文书的附属信息时间。电子数据时间审查的方法包括以下几种:电子数据机器时间与诉讼时间的比对,可特别关注电子数据首次收集、提取时间;电子数据机器时间与自然时间的比对,由此发现电子数据机器时间被人为篡改的情况;电子数据机器时间与机器时间的比对,由此还原电子文件生命周期,或发现异常电子数据。
The severity of cybercrime and the development of electronic forensics technical standards have introduced new requirements for jurists.The time factor is a new perspective for reviewing the authenticity of electronic evidence.The time review of electronic data not only relies on the traditional time elements principle and its systematic principle but also expands the contradiction review method of traditional evidence examination.It innovatively combines time features with its electronic trace principle.On one hand,the time information of electronic data comes from accessory information time,network multi-node time,timeline analysis,and natural time in the electronic data entity.On the other hand,it comes from expanded forms,including document recording time,screenshot reflection time,time information within optical discs,and auxiliary information time in electronic document versions.The methods of electronic data time review include the following aspects:the comparison of machine time and litigation time,with special attention to the first collection and extraction time of electronic data;the comparison of machine time with natural time,thereby discovering the artificial modification of machine time;and the comparison of machine time for a comprehensive evaluation,aiming to restore the electronic file life cycle and identify time anomalies.
