摘要
随着商标申请量逐年大幅上涨,我国现行商标审查制度已无法满足改革需求,优化商标审查制度势在必行。尽管国家知识产权局新公布的《商标法修订草案(征求意见稿)》涉及多项实体与程序性规则的改变,以优化商标确权程序,实现商标审查的提质增效,但仍存在进一步完善的空间。德国和日本的商标法修订后,其审查制度有可供借鉴之处。为完善我国商标审查制度,针对现存问题,建议《商标法》第五次修改作出相应调整:取消相对事由审查、实行商标异议后置、增设异议纠纷的自我和解机制、增设以商标使用为标准的快速审查渠道、提高商标审查费用。
As the number of trademark applications rise dramatically by years,current trademark examination system has been unable to meet the requirements of the reform,thus changes to trademark examination system are unavoidable.The Draft Amendment to the Chinese Trademark Law(Draft for Public Comments)unveiled by China National Intellectual Property Administration shows many revisions on substantive and procedural rules,in order to optimize the trademark confirmation procedure and achieve both quality and efficiency of trademark examination,however,there is still room for further improvement.The trademark laws as revised in Germany and Japan respectively are good lessons to learn on their examination systems.In order to reform and improve China's trademark examination system,and in view of the existing problems,it is suggested to make corresponding changes in the fifth revision of the Trademark Law:revising the comprehensive trademark examination system and abandoning the examination on relative grounds;introducing post-grant opposition;adding self-reconciliation mechanism for opposition disputes;building a channel for accelerated examination based on trademark use;and increasing the costs of trademark examination.
