摘要
新《职业教育法》是新时期职业教育领域推行“良法”“善治”的重要举措。其“良法”特征主要体现在:一是立法过程和立法依据坚持民主立法、科学立法和依法立法;二是立法体系实现与相关教育法、社会法以及其他法律“法法衔接”;三是法律文本逻辑框架结构严谨、语言表达“软硬兼备”;四是立法内容紧紧把握社会经济发展客观规律、职业教育发展的客观规律和人才成长客观规律;五是坚持公平正义原则,实现对职业教育不同法律关系主体权责和利益的合理分配。
The new Vocational Education Law is an important measure to implement“good law”and“good governance”in the field of vocational education in the new era.Analyzing its characteristics of good law is mainly reflected in:firstly,the legislative process and basis adhere to democratic legislation,scientific legislation and legislation according to law;Secondly,the legislative system realizes the“Law-law Cohesion”with relevant education laws,social laws and other laws;thirdly,the logical framework of legal text is rigorous,and the language expression is“both hard and soft”;fourthly,the content could firmly grasp the objective laws of the development of social economy,vocational education and talent growth;fifthly,the value adhere to the principle of fairness and justice,and could realize the distribution of rights,responsibilities and interests of different legal subjects of vocational education.
