摘要
目前司法机关正在进行将人工智能用于刑事证据判断的尝试,但人工智能在证明标准判断方面只能发挥有限的作用。这主要是基于如下几点原因:证明标准判断难以完全设计为计算机可以理解和执行的算法;人工智能无法通过人工输入或机器学习而具备判断证明标准所需的人类经验;人工智能所采取的推理方法与司法实践中证据推理所需要的推理方法并不相同;在技术上无法实现人工智能对证据判断所需要的人类非逻辑思维的模拟;人工智能无法进行真正的证据说理。但在刑事证明标准判断的部分领域,人工智能依然能够发挥有效的辅助作用。人工智能在刑事证据判断中的作用应定位为一种有限性、辅助性的手段。
At present, judicial authorities are trying to use artificial intelligence(AI) in judging criminal evidence, but AI can only play a limited role in judgment of proof standard, which is mainly based on the following reasons. It is difficult to completely design an algorithm that can be understood and executed by a computer for judgment of proof standard. AI is unable to fully grasp the human experience required for the judgment of proof standard by manual input or machine learning. The reasoning method adopted by AI is not the same as that required by evidence reasoning in judicial practice. It is technically impossible to realize the simulation of human illogical thinking required by AI to judge the evidence. Furthermore, AI cannot make real evidence reasoning. But in some areas of judgment of proof standard, AI can still play an effective auxiliary role. The role of AI in the judgment of criminal evidence should be defined as a limited and auxiliary means.
