摘要
民营经济发展速度快,创新能力强,是推动中国式现代化的“生力军”。与公有制经济相比,民营经济在市场交易中往往处于劣势地位,有必要通过法治方式予以完善。促进民营经济健康发展应当遵循以下法治路径:首先,以习近平法治思想为指导,坚持社会主义核心价值观。其次,通过《中华人民共和国民法典》与《中华人民共和国民营经济促进法》共同构建基础保护与特别保护相结合的法治体系。最后,切实代入民营经济的市场交易情景中,弥补民营企业与国有企业、中小型民营企业与大型民营企业之间的实力差距,在纵向与横向双重维度营造健康的营商环境。司法公正是维护社会公平正义的最后一道防线,应当准确解释作为市场交易基础的合同,完善配套制度解决司法的掣肘因素,从而有效保护民营经济的合法权益,提高促进民营经济发展的法治水平。
With rapid development and strong innovation ability,private economy is the"fresh force"to promote Chinese-style modernization.Compared with the public ownership economy,the private economy is often at a comparative disadvantage in market transactions,making it necessary to improve this situation through the rule of law.To promote the healthy development of the private economy,the following law-based approaches should be adopted.Firstly,guided by Xi Jinping Thought on the Rule of Law,we must uphold the core socialist values.Secondly,we should establish a legal system combining basic protection with special protection through the joint application of the Civil Code of the People's Republic of China and the Private Economy Promotion Law of the People's Republic of China.Finally,we should effectively integrate into the market transaction scenarios of the private economy,narrow the strength gap between private enterprises and state-owned enterprises,as well as between small and medium-sized private enterprises and large private enterprises,and foster a sound business environment from both vertical and horizontal dimensions.Judicial justice is the last line of defense for safeguarding social fairness and justice.We should accurately interpret contracts,which serve as the foundation of market transactions,improve supporting systems to address the restrictive factors hindering judicial practice,and thus effectively protect the legitimate rights and interests of the private economy and enhance the level of rule of law that promotes the development of the private economy.
