摘要
统一调用监察官办案作为一项创新实践,在优化监察资源配置、提高反腐效能等方面具有显著制度价值。相较于传统管辖制度,调用机制展现出独特优势,宜与管辖制度协同发力,共同推动监察工作高质量发展。然而,该制度的合宪性基础尚待澄清。基于监察委员会与检察院、监察官与检察官之间的同构性,二者的调用机制应纳入统一分析框架,以维护法秩序的统一。监察官调用制度总体上具备充分的法治基础,但制度本身的宪制合理性并不意味着现有规范结构已具备直接、充分的形式合法性,还需明确适用主体与适用情形以提高规范性、通过权力机关批准与任命程序以增强正当性、确立清晰的内部领导关系与责任机制以保障协调性,以补强其法理基础。
As an innovative practice,the unified transfer of supervisory officials for case handling has significant institutional value in optimizing the allocation of supervisory resources and improving anti-corruption efficiency.Compared with traditional jurisdiction systems,the transfer mechanism shows unique advantages and should work in coordination with jurisdiction systems to jointly promote the high-quality development of supervisory work.However,its constitutionality remains to be clarified.Due to the isomorphism between supervisory commissions and the people’s procuratorates,and that between supervisory officials and procurators,their respective transfer mechanisms should be considered within a unified analytical framework to maintain the unity of legal order.On the whole,the unified transfer system of supervisory officials has a sufficient legal foundation.However,the constitutional rationality of the system itself does not mean that the existing normative structure has direct and sufficient formal legality.In the future,it is necessary to clarify the applicable subjects and situations to enhance standardization,strengthen legitimacy through the approval and appointment procedures of power organs,and establish clear internal leadership relations and responsibility mechanisms to ensure coordination,so as to reinforce its legal basis.
