摘要
农村集体财产经营应坚持集体财产成员集体所有、分类经营、稳健经营等基本原则。农村集体财产经营既可由农村集体经济组织作为直接主体,也可由单位或者个人作为间接主体。农村集体财产经营的客体范围涵盖了法律列明的农村集体财产,应厘清农村集体财产与农村集体资产的区别,以及农村集体财产经营含义对客体范围的影响。农村集体财产经营的具体方式是,既可由农村集体经济组织直接经营,也可依法交由单位或个人间接经营。在上述制度框架的基础上,需结合不同类型财产细化政策法规,构建充分体现农村集体财产特点的经营制度规范体系。
The management of rural collective property should adhere to the basic principles of collective ownership by members,classified management,and prudent management.The rural collective economic organization can be the direct entity for management,while units or individuals can serve as indirect entities.The scope of objects for rural collective property management includes legally listed rural collective property.It is necessary to clarify the difference between rural collective property and rural collective assets,as well as the impact of the meaning of rural collective property management on the scope of objects.Specific methods for rural collective property management can be directly operated by the rural collective economic organization or indirectly operated by units or individuals in accordance with the law.Based on the aforementioned institutional framework,more detailed policies and regulations should be formulated in combination with the characteristics of different types of property,to construct a management system and regulatory framework that fully reflects the characteristics of rural collective property.
