摘要编纂教育法典是当前法学界和教育学界重点关注的课题,教育基本原则是贯穿教育法典始终的一条主线。教育基本原则在教育法典中发挥着统领作用,是指导教育法典制定和实施的价值规范。党对教育事业的全面领导原则要求一切教育主体及其教育活动都必须坚持中国共产党的领导。落实立德树人根本任务原则要求加强社会主义核心价值观教育,培养德智体美劳全面发展的社会主义建设者和接班人。教育公平原则涵盖教育形式公平和教育实质公平,是教育活动的灵魂。教育公益原则要求教育活动应当符合国家和社会公共利益,以公共利益为依归。依法治教原则涵盖教育立法、依法行政、依法治校等方面,强调要将法治的理念、方式运用到教育活动中。正当程序原则是教育活动最低限度的程序要求。这六项教育基本原则涉及教育活动的领导主体、根本任务、价值理念、目标导向、实施路径和程序要求,是贯穿教育法典全部内容的主线。 The compilation of an education code is a key topic of concern in the current legal and educational fields,and the basic principles of education are a main thread that runs through the entire education code.The basic principles of education play a leading role in the Education Code and are the value norms that guide the formulation and implementation of the Education Code.The principle of the Party's overall leadership over education requires that all educational subjects and their educational activities must adhere to the leadership of the CPC.The fundamental task of implementing the principle of cultivating morality and nurturing talents requires strengthening the education of socialist core values,cultivating socialist builders and successors with comprehensive development in morality,intelligence,physical fitness,aesthetics,and labor.The principle of educational equity encompasses both formal and substantive equity in education,and is the soul of educational activities.The principle of educational public welfare requires that educational activities should comply with the national and social public interests,and be based on the public interest.The principle of governing education by law covers education legislation,administration by law,and school governance by law,emphasizing the application of the concept,methods,and system of the rule of law in educational activities.The principle of due process is the minimum procedural requirement for educational activities.These six basic principles of education involve the leadership subject,fundamental tasks,value concepts,goal orientation,implementation path,and procedural requirements of educational activities,and are the main thread that runs through the entire content of the Education Code.
