摘要
在职务发明创造专利权共有关系中,科研人员在共有收益分配方面具有直接性和主动性。专利共有收益分配是体现共有人之间合作关系的重要内容,也是实现利益平衡的重要机制。在按份共有中,专利共有人可以依据共有份额对收益进行合理分配。专利权共有的收益分配比例应当以共有人对技术成果贡献度和承担风险程度为依据合理确定。专利共有人对职务发明创造专利共有收益分配的知情权和监督权应当得到有效保护,防止共有人收益分配请求权受到侵害。
In the co-ownership relationship of patent rights for employee inventions and creations,researchers have directness and initiative in the distribution of the benefits of co-ownership.The distribution of benefits from co-ownership patent rights is an important aspect of the cooperative relationship between co-owners and a crucial mechanism for achieving a balance of interests.In co-ownership by shares,co-owners can allocate profits reasonably based on their shares of co-ownership.The distribution of shared benefits of patent rights should be reasonably determined based on the contribution and risk level of the co-owners to the technological achievements.The rights of patent co-owners to know and supervise the distribution of shared benefits of patents for employee inventions and creations should be protected effectively,so as to prevent the infringement of the right to claim the distribution of profits among co-owners.
