摘要
在职务发明创造专利权共有关系中,共有主体呈现多样性和复杂化的特点。职务发明创造专利共有人之间具有协同性,并且形成兼具合作性与效率性的共有关系。单位和科研人员均可以基于对职务发明创造的贡献成为专利权共有人。科研人员取得发明创造完成人资格认定对其成为专利共有人具有显著影响。在职务发明创造专利共有中,实质共有人有权请求成为专利权共有人。在职务创造专利共有人之间有相互报告发明创造成果的义务,保障其他共有人对职务发明创造的知情权。
In the co-ownership relationship of patents for employee inventions and creations,there is a charac-teristic of diversification and complexity among the co-owners.The co-owners of patent rights for employee in-ventions and creations have a collective nature and form a relationship that combines cooperation and efficiency.The units and researchers can both become joint owners of patent based on their contributions to employee in-ventions and creations.In the co-ownership of patents for employee inventions and creations,researchers who have made substantial contributions to innovation have the right to request to become the co-owners of patent rights.The co-owners of patent rights for employee inventions and creations have the obligation to report their inventions and creations achievement to other co-owners,and guarantee the right to know of other co-owners regarding employee inventions and creations.
