摘要
目前理论上关于宅基地资格权的主体及其认定条件难以形成共识,实践中拓展宅基地资格权的内容却导致宅基地使用权被架空,根源在于未厘清宅基地申请行为的私法属性与公法特征,使宅基地资格权承载了本该由宅基地使用权制度完善予以实现的改革目标。宅基地资格权主体应为结婚的集体成员,权利内容为向集体申请宅基地或者其他形式的居住保障,如此方能顺畅与宅基地使用权的制度衔接,在充分保障集体成员居住权益的同时,促进宅基地的市场化流转。
Currently,there is a lack of consensus in theoretical discourse regarding the subject of rural homestead qualification rights and the criteria for their determination.In practice,the expansion of the content of homestead qualification rights has led to the undermining of homestead use rights.The root cause lies in the failure to clarify the private law attributes and public law characteristics of homestead application behavior,which has resulted in these rights bearing the burden of reform objectives that should have been achieved through the improvement of the homestead use rights system.The subject of homestead qualification rights should be married collective members,with the right content being the application to the collective for a homestead or other forms of residential security.Only in this way can the system interface with homestead use rights be smoothly connected,ensuring the full protection of collective members’residential rights and interests while promoting the market-oriented circulation of homesteads.
