摘要
编纂行政基本法典,首先应制定行政法总则。行政法总则在行政基本法典中居于基础地位,发挥着统一基本概念、明确基本原则、建立基本制度的功能。围绕规范行政活动的逻辑主线,行政法总则的主要内容包括:基本规定,基本原则,公民、法人和其他组织的行政权利,行政主体,行政行为,行政责任。同时,应当处理好行政法总则与行政程序法的关系,行政法总则与提升行政效能的关系,优化行政法总则的立法技术,增强行政基本法典的体系性,确保以“提取公因式”为基本内容的行政法总则与行政基本法典各分则的有机衔接。
To compile the Basic Administrative Code,the General Provisions of Administrative Law should be formulated first.The General Provisions of Administrative Law hold a fundamental position in the Basic Administrative Code and play the functions of unifying basic concepts,clarifying basic principles,and establishing basic systems.Centering on the logical main line of regulating administrative activities,the main contents of the General Provisions of Administrative Law include basic provisions,basic principles,the administrative rights of citizens,legal persons,and other organizations,administrative subjects,administrative acts,and administrative responsibilities.At the same time,it is necessary to properly handle the relationship between the General Provisions of Administrative Law and the Administrative Procedure Law,as well as the relationship between the General Provisions of Administrative Law and the improvement of administrative efficiency.It is also essential to optimize the legislative techniques of the General Provisions of Administrative Law,enhance the systematicness of the Basic Administrative Code,and ensure the organic connection between the General Provisions of Administrative Law,which take the"extraction of common factors"as the basic content,and each division of the Basic Administrative Code.
