传统村落宅基地古民居再利用的法律制度构建

摘要推进传统文化村落宅基地上古民居的再利用,不仅关乎农民的切身利益,更是激活乡村文化资源、释放农村发展潜力、推动共同富裕的重要举措。古民居的再利用受其利用模式、宅基地盘活形式以及参与主体等多种因素影响,在实践中呈现出复杂特性。现有模式需解决宅基地盘活困难、古建筑保护不足、利用主体间矛盾等难题。上述难题的根源在于我国宅基地流转体系不健全、古建筑保护立法不完备、利益分配机制不明确。因此,构建相应的法律实现制度,催化相关法律法规及政策的出台与有效实施尤为必要。具体来说,应构建多方位宅基地流转体系、数字化建设机制和主体合作共建机制,以支撑传统村落古民居的保护与利用。 Promoting the reuse of ancient residential buildings on rural homesteads in traditional cultural villages is not only crucial for safeguarding farmers'vital interests but also a significant measure to activate rural cultural resources,unleash rural development potential,and promote common prosperity.The reuse of ancient residential buildings is influenced by multiple factors,including the utilization mode of the buildings,the revitalization form of the homesteads,and the participating entities involved in the reuse process,displaying complex characteristics in practice.Existing models need to address challenges such as difficulties in revitalizing homesteads,preserving ancient buildings,and resolving conflicts among utilizing entities.A careful analysis of the root causes of these challenges reveals issues such as an incomplete homestead transfer system,inadequate legislation for ancient building protection,and unclear mechanisms for benefit distribution in China.Therefore,it is particularly necessary to establish corresponding legal and institutional frameworks to catalyze the introduction and effective implementation of relevant laws,regulations,and policies.Specifically,it is essential to develop a multi-faceted homestead transfer system,a digital construction mechanism,and a collaborative mechanism among entities to support the protection and utilization of ancient residential buildings in traditional villages.
