摘要
习近平法治思想具有思想政治性和平等性相统一的特性。全面依法治国最重要的属性是政治性,全面依法治国本质是完善中国特色社会主义的制度和社会关系架构,最核心的部分是党的领导。党的领导是为了支持人民当家作主,依法治国就是为了保证党能够支持人民当家作主,党的领导和法治具有统一性。党的领导和全面依法治国是统一的。党的领导制定的法制共同确立了中国社会的最普遍的规矩。法制是普遍的、客观的,依靠法制来治理国家,具有根本性、全局性、长期性。法制的平等性和政治性的统一体现在法律面前人人平等和要求执法的人守法,党委和政府支持和保护执法机关符合法律和程序的执法,从而维护了法律的权威。全面依法治国,要求法治国家、法治政府、法治社会一体建设,三者各有侧重、相辅相成,从而实现全面依法治国的总目标。
Xi Jinping’s thoughts of the rule of law has the characteristics of the unity of politics and equality.The most important attribute of comprehensive law-based governance is its political nature.The essence of comprehensively governing the country according to law is to improve the society with Chinese characteristics and social relationship structure.The core part of this structure of social relations is the leadership of the Party.The leadership of the Party is for supporting the people as masters of the country,and governing the country according to law is to ensure that the party can support the people as masters of the country,as well as the unity of the Party’s leadership and the rule of law.The Party’s leadership and the comprehensive rule of law are unifi ed.The legal system formulated by the leadership of the Party has jointly established the most common rules of Chinese society.The rule of law is universal and objective.Relying on the legal system to govern the country is fundamental,overall,and long-term.The unity of politics and equality in the legal system is embodied in the equality of everyone before the law and the law-abiding requirements of those who enforce the law.The Government supports and protects law enforcement agencies in accordance with the law and procedures,thus upholding the authority of the law.Comprehensively governing the country according to law requires the integrated construction of a country under the rule of law,a government under the rule of law,and a society under the rule of law.The three each have their own focus and complement each other,so as to achieve the overall goal of comprehensively governing the country accodring to law.
