摘要
解构数据承载利益的复杂性是数据产权配置绕不开的难题。解题第一步是认清谁参与了数据价值生产,在其中发挥着何种作用。目前,学界对自然人数据来源者利益保护的探讨,主要集中在隐私权及个人信息保护方面,而自然人参与数据利益分配的资格长期被悬置,成为数据法中被忽视的议题,知情同意等机制可能在其中沦为为资本增值服务的角色。基于数据来源是价值续造的起点、普遍免费服务并非合理对价及促进流通激励、保护数字人格等方面的考量,可以采取货币兑换、权能兑换及集体托管等路径,实现对自然人数据来源者的财产权保护。
The complexity of deconstructing data carrying benefits is an unavoidable challenge in data property allocation.The first step in solving the problem is to recognize who is involved in the production of data value and what role it plays.Among them,the discussion on the protection of the interests of natural person data sources mainly focuses on privacy rights and personal information protection,leading to the deprivation of the qualification of natural persons to participate in the distribution of data benefits,and the risk of mechanisms such as informed consent becoming puppets of capital appreciation.Based on the consideration that data sources are the starting point for value creation,universal free services are not reasonable considerations,and promoting circulation incentives,protecting digital personalities,etc.,we can try paths such as currency exchange,power exchange,and collective custody to clarify the property rights protection of data sources.
