摘要
妨害传染病防治罪主观罪过的争议由来已久。理论上大致存在过失说、故意说与混合罪过说等主张,各学说内部又存在不同观点,可谓莫衷一是。故意说无法完全说明本罪的构成要件,应连同其修正一并被否定;混合罪过说背离我国刑事立法与理论,不应坚持这一折衷方案。作为通说的过失说具有优越性,能妥善处理结果要素,符合法定刑设置,且恰当区分关联罪名。化解对过失说的质疑需结合后疫情时期的总体社会特征与法定犯时代罪过判断的结果标准,肯定过失危险犯的法理。这是妨害传染病防治罪罪过理论深入研究的应然归宿。
The dispute about the subjective guilt of the crime of impairing the prevention and control of infectious diseases has a long history.In theory,there are generally such propositions as the theory of negligence,the theory of intent and the theory of mixed guilt.There are different views within each theory,which can be said to be incongruous.The intentional statement cannot fully explain the constitutive requirements of this crime,and should be denied together with its amendment.The theory of mixed guilt deviates from China’s criminal legislation and theory,and should not adhere to this compromise plan.As a general theory,the theory of negligence has advantages,which can properly handle the elements of result,conform to the legal setting of punishment,and properly distinguish the related charges.To dispel the doubts about the theory of negligence,it is necessary to combine the overall social characteristics of the post-epidemic period with the result standard of the judgment of guilt in the era of statutory crime,and affirm the jurisprudence of the negligent dangerous crime.This is the proper end result of the in-depth study of the theory of the crime of impairing the prevention and treatment of infectious diseases.
