摘要
体育彩票表达权利的保护是彩票行业立法必须关注的一个重点内容,也是体育彩票健康发展的重要保障。采用文献资料调研、专家访谈、逻辑分析等研究方法,对彩票法律性质的证券说与合同说的相关文献进行梳理,认为我国体育彩票具有有价证券属性,且具备无记名证券属性和无因证券属性;彩票属于民事合同、买卖合同和要物合同。基于此对体育彩票表达的权利进行分析,提出我国体育彩票表达彩民的期待权、消费权与隐私权;分析当前我国体育彩票表达权利的实现困境,是由发行主体和销售主体的违约行为、体育竞猜型彩票的自身特征、相关法律法规的缺陷所导致。提出我国体育彩票的立法展望:形成“事前+事后”全过程保护模式、完善体育竞猜型彩票相关规则制度、加强“公权”与“私权”分明的配套法律建设。
The protection of expression right for sports lottery is a key content that the legislation of lottery industry must pay attention,and also an important guarantee for the healthy development of sports lottery.By means of literature research,expert interview and logical analysis,this paper sorts out the relevant literature of the legal nature of lottery securities theory and contract theory.It holds that China’s sports lottery has the property of negotiable securities,bearer securities and non-cause securities.It is considered that lottery belongs to civil contract,sale contract and possession contract.Based on the analysis of the rights expressed by sports lottery,it is pointed out that sports lottery in China expresses the expectation right,consumption right and privacy right of lottery users.This paper analyzes the difficulties in realizing the right of expression of sports lottery in China:it is caused by the breach of contract of issuing subject and selling subject,by the characteristics of sports lottery,and by the defects of relevant laws and regulations.The paper proposes the legislative prospect for Chinese sports lottery as follows:forming the whole process protection mode of"before+after",perfecting the rules and regulations of sports lottery,and strengthening the supporting legal construction of distinguishing"public rights"and"private rights".
