数字平台生态系统的反垄断法定位与规制 被引量:22

摘要 数字平台在发展演进中形成的生态系统,对反垄断法的适用带来了众多挑战。在我国平台经济领域相关市场界定实践中,司法机关倾向于分离出单一商品市场进行界定,如“微信表情包”“微信公众号”案,而行政机关在执法中已考虑到双边市场,但皆未将生态系统纳入考虑范围。数字生态系统的运作存在四个层次,具有三种内部协调机理,并在对外竞争中呈现三个特征。在平台封禁、数字版权的反垄断分析场景中纳入数字平台生态系统的竞争分析,可以带来全新的视角。针对数字经济领域的反垄断法规制,应当在各个环节纳入数字平台生态系统的视角,进行多层次、分类型的竞争分析,重点考察新型竞争行为,在事前审查和事后规制两端探索一条符合生态系统运作特点的中间道路。 The ecosystem of digital platforms that has come into being in the development of the platforms themselves has posed challenge to the application of the anti-monopoly law.In the legal practice of defining relevant market in China’s platform economy,the court tends to single out certain market,such as“emoji package”,and“WeChat account”,for definition,while administrative de⁃partments often take into account the bilateral markets,but not the ecosystem as a whole.The opera⁃tion of the digital ecosystem has four levels,three internal coordination mechanisms,and three features in external competition.Incorporating the competition analysis of the digital platform ecosystem into the antitrust analysis scenarios of platform bans and digital copyrights can bring a new perspective.When enforcing the anti-monopoly laws and regulations in the digital economy,it is necessary to in⁃corporate this perspective in all aspects,conduct multi-level and categorized competition analysis,fo⁃cus on new competitive behaviors,and explore a middle way between ex ante and ex post regulation which is compatible with the characteristics of the digital ecosystem.
