论人工智能领域被遗忘权的保护:困局与破壁 被引量:8

Protection of the Forgotten Right in the Field of Artificial Intelligence:Difficulties and Breaking

摘要 基于"数据删除"概念的被遗忘权随着《欧洲数据保护指令》的颁布和相关判例的影响已成为个人信息法领域的热点,对信息主体、数据控制人和监管机构都提出了思考、争议与挑战,其中就包括被遗忘权如何适用于人工智能(AI)领域的问题。现行法律并未充分考虑人类和机器在记忆与遗忘中的异同,故在现有的人工智能背景下,被遗忘权的实施面临技术瓶颈和规制障碍,无法实现其法律目的。可能的解决路径需在跨学科、跨技术层面更新权利理念和行权措施,融合AI发展与被遗忘权完善的兼容与互补。具体实施方案包括:基于"有意遗忘"、权利平衡的法律和政策完善方案,以及以新型芯片、程序和代码为载体的"法技术性"创新工具所引导下的综合性"技术、法律/政策集成式"解决方案。 The right to Be forgotten has become a hotspot in the field of personal information law with the promulgation of the Euro・pean GDPR and related jurisprudence.It has raised concerns,disputes and challenges for information subjects,data controllers and regulatory agencies,including questions about how the right to forget applies to the field of artificial intelligence(AI).The current law does not fully consider the similarities and.differences between humans and machines in memory and forgetting.Therefore,under the current artificial intelligence background,the implementation of the right to be forgotten faces technical bottlenecks and regulatory obstacles,and cannot achieve its legal purpose.The possible solution path needs to update the concept of rights and exercise measures at the interdisciplinary and cross-technological level,and integrate the development of AI and the perfect compatibility and complementary of the right to be forgotten.The specific implementation plan includes:a law and policy improvement plan based on"intentional forgetting"and rights balance,and a comprehensive"technology,law/policy integration"guided by"law technology"innovative tools based on new chips,programs and codes.
