摘要
突发公共卫生事件应急中的技术治理对推动科学决策、精准防疫、提高防控效率具有重大实践价值,当前新冠肺炎疫情防控中人工智能、大数据、物联网、云计算等新技术的多场景运用,为此作了最好的注解。然而,突发公共卫生事件应急中的技术治理,仍然面临疫情防控数据滥用、技术治理对部分治理议题法律性质和矛盾的遮蔽、技术差误导致的算法规制失序质疑、技术治理对行政相对人法律救济权利的相对剥夺等行政法治风险。为此,除针对技术治理本身的技术局限性,完善以区块链技术为总成架构的行政应急技术治理机制之外,还须从技术治理之法律规训的角度,制定科学合理的技术治理规则,强化以计算法律学为主导的行政学理支撑,健全与技术治理相契合的突发公共卫生事件政府应对架构,构建以“算法技术”为核心的“精明行政”体系,将蕴含智能思维的技术治理置于法律治理范式的规范指引和价值归化之下,以此发挥突发公共卫生事件技术治理的最优支撑效能。
The technical governance of public health emergencies is of great practical value in promoting scientific decision-making,accurate epidemic prevention,and improving prevention and control efficiency.The novel coronavirus pneumonia prevention and control in the new crown,artificial intelligence,big data,Internet of things,cloud computing and other new technologies,the use of multi scene,for this reason has done the best annotation.However,the technical governance in public health emergencies is still faced with the risk of administrative rule of law,such as the abuse of epidemic prevention and control data,the concealment of the legal nature,contradictions of some governance issues by technical governance,etc.Therefore,in addition to improving the administrative emergency technical governance mechanism with blockchain technology as the assembly structure,it is necessary to formulate scientific and reasonable technical governance rules from the perspective of legal training of technological governance,strengthen the administrative theoretical support led by computational law,and improve the public health emergency governance mechanism corresponding to technological governance Government response structure,the construction of“smart administration”system with“algorithm technology”as the core,and other policy measures,put the technology governance containing intelligent thinking under the normative guidance and value domestication of legal governance paradigm.
