水利工程淹没库区苗木补偿的困境分析及对策研究

摘要 当前水利工程实物调查规范中虽明确对园地、林地中的苗圃调查方式,但未有对其地上苗木的调查方式。除部分省份外,各省的综合区片价虽明确工程区的青苗补偿标准,但由于库区土地的可计划性,也未曾考虑库区移民户土地上苗木的补偿标准。同时调查阶段库区土地尚未分地到户,苗木测量也只能停留在整体数据上,加之当地的抢栽种,往往导致后期国家批复的苗木面积、耕地面积、移民户及承包户掌握的苗木面积相差甚远,而导致实施进入困境。以HZS工程库区分苗到户为例,总结经验教训,按照只认地主、以地限苗、村民自治等工作原则,形成苗木补偿到移苗补偿的困境解决路径,并提出设计规范中增加库区苗木调查原则,地上苗木与土地同步调查同步规划,综合区片价文件根据物价标准及成活率确定补偿标准区间。 In the current code of physical investigation of water conservancy projects,although the investigation method of nursery in garden and forest land is clear,there is no investigation method of seedlings on the ground.In addition to some provinces,although the comprehensive area price of each province clearly defines the compensation standard for young seedlings in the project area,the compensation standard for seedlings on the land of immigrates in reservoir a rea has not been considered due to the planning of the land in reservoir area.At the same time,in the investi gation stage,the land in reservoir area has not yet been divided into households,and the seedling measurement can only stay on the overall data.In addition,the local emergency planting often results in the difference of seedling area approved by the state,cultivated land area,and the seedling area mastered by immigrants and contractors,which leads to the implementation dilemma.Taking the HZS Project reservoir area as an example,this paper sums up the experience and lessons,according to the working principles of only recognizing the landlords,limiting the seedlings in local areas,and villagers'autonomy.This paper also puts forward the principle of adding the nursery stock investigation in reservoir area in design specifications,the synchronous planning of above ground nursery stock and land investigation,and t compensation standard interval determined by comprehensive area price document according to price standard and survival rate.
