摘要
残疾人社会保障立法,事关我国8500万残疾人的切身利益,事关社会的公平公正、文明进步。残疾人社会保障立法是促进残疾人社会保障转型发展的内在要求。本文分析了我国残疾人社会保障的必要性和可行性。研究认为,我国残疾人社会保障经历了社会救济、社会保险、社会福利的发展阶段,目前正处在急需加强社会服务推动残疾人社会保障转型的关键时期。在2019年人均GDP达到一万美元后,我国经济社会进入了一个重大转型期,残疾人社会保障同其他群体的社会保障一样,需要从“基本生存”“物质保障”向“发展需要”及“服务保障”转型,这需要一部专门的法律来保障残疾人的权益。
The legislation for social security of persons with disabilities concerns the vital interests of 85 million persons with disabilities in China,as well as the social justice and social progress.The legislation is an inherent requirement to promote the transformation and development of social security for persons with disabilities.This article analyzes the necessity and feasibility of social security for persons with disabilities in China.The study shows that China’s social security policy for persons with disabilities has gone through the development stages of social relief,social insurance,social welfare,and is currently in a critical period of transition to strengthen social service.After China’s per capita GDP reached 10,000 U.S.dollars in 2019,China’s economy and society have entered a major transitional period.Social security for persons with disabilities,like social security for other groups,needs to transform from“basic survival”and“material security”to“development needs”and“service security”.A special law is needed to protect the rights of persons with disabilities.
