新加坡人民行动党内部规程与法律衔接模式及对我国的启示被引量：2

The Model of Interconnection between Law of Singapore and the Rule of People’s Action Party and its Enlightenment to China

摘要新加坡的地理位置、国家历史背景、所处的国际经济地位以及在人民行动党长期厉行法治方面所表现出来的政治魄力,共同造就了一种以低腐败率为突出特点的新加坡政党法治治理范式。人民行动党遵循的是将党的宗旨与具体规程融入宪法法律,以不断加强执政党主导立法保证党的主张与国家法律呈现高度统一、以政党自律保障规法衔接的模式,其闪光点在于:党在内部规程与国家法律之间设有明显的界限,采取党纪国法各自分工配合却又相互辅助的衔接机制,党的自律对于党规国法衔接也起到保障作用。当然,人民行动党党内规程与国家法律也会出现龃龉,但不变的是国家厉行法治的根本原则。党规与国法衔接是中国共产党领导的法治建设中一个不容回避的课题,基于人民行动党模式的利弊分析,要注意以下五个方面:以党领导立法实现党的精神与国家法律相契合;加强国家监察规范依据的体系化建设;以法律作为国家规范体系的重心;坚决维护法律权威;加强执政党在立法立规之初对于二者协调性的严格审查。 Singapore' s geographical location, national historical background, international economic status and its political assertiveness in implementing the rule of law in the People's Action Party ( PAP) for a long time have jointly created a new model of political Party rule of law governance in Singapore featuring extremely low corruption rate. PAP follows the cohesion mode just like this: the Party 's aim and specific procedures can be incorporated into the constitution law, in order to continuously strengthen the dominant legislation to ensure the Party' s regulation and the national law present highly unified, the PAP discipline guarantee the cohesion between regulation and law. The sparkle in the above model is that the internal discipline and national law share very clear boundaries, the Party adopt the link mechanism of Party discipline and state law to cooperate with each other but assist each other, furthermore, the Party' s discipline for early law also play a role to ensure it' s cohesion. On the analysis of the pros and cons of the PAP model, we should pay attention to the following aspects in the future: strengthening the systematic construction of the basis of national supervision and regulation;taking the law as the center of national standard system;firmly upholding the authority of the law;the ruling Party should strictly examine the coordination between the regulation and law at the beginning of the legislation.
