专利权人商品化动机及政策效果分析——以我国高校转化专利为例被引量：9

Investigation on the Patentees’ Commercialization Motives of Chinese Academic Patents and Effects of Policy: Evidence from Traded Patents in Chinese Colleges and Universities

摘要 [目的/意义]已有的国内高校专利数据分析主要侧重于揭示专利的数量或基于专利类型及授权情况的质量分析以及高校发明人申请专利的动机,有关产学研合作专利申请动机的研究很少。该研究旨在从合作动机角度分析专利数据,揭示我国高校与企业合作申请或企业接受高校转让许可专利等的专利权人(包括申请进入审查阶段的专利的申请人、授权公告以及转让变更后的权利人(含专利失效前的权利人)的专利商品化动机情况,以及政策对提升专利商品化动机的作用。[方法/过程]构建基于专利授权及专利寿命的专利权人商品化动机模型,并以2000-2009年10年间全国高校转化专利数据及各级政府出台的相关政策为例进行实证分析。[结果/结论]结果显示,高校已转化专利的专利权人中:国企的专利商品化动机水平较高于其他类型企业,高校的专利商品化动机水平与高校综合实力有关;10年期间的专利商品化动机水平整体呈下降趋势;不同地区之间的动机水平存在差异,各地区早期的动机水平与其专利资助政策有关,但近期的专利资助政策对专利商品化动机水平的促进作用不大。 [Purpose/Significance]Previous researches mainly focused on the number, the licensing of patents and the motive of patenting, while little attention was paid to the motive of universities and enterprises in the trading of academic patents. In this study, motive of the patentees(the applicants of a patent in examination or the current patentees of a granted patent) in the university-enterprise cooperation was investigated.[Method/Process]Based on the licensing and life of patents, evaluation models and indexes of commercialization motive were built for patentees, universities and enterprises respectively, and practiced on the traded academic patents from the year 2000 to 2009.[Result/Conclusion]The results showed that state-owned enterprises’ indexes of commercialization motive were mostly higher than those of the other types of enterprises. The universities’ indexes were partly in proportion to their comprehensive capabilities. The patents from different regions of China presented different indexes of commercialization motive, which was related to various local support policies.
