摘要
以法律规范的形式对能源技术进行激励与保障是能源技术规制的应有之义。能源技术监管亦是能源技术规制不可缺乏的重要内容。可持续发展视野下,我国能源技术进步面对碳锁定普遍存在阻碍可再生能源技术与能效技术的广泛应用,大部分能源技术的应用成本高企,可再生能源产业的发展极大依赖政策支撑,核心能源技术缺少自主研发依赖进口,专利产权得不到充分保护以及缺少明晰的技术监管规范等严峻挑战,精准激励与审慎监管并重是能源技术规制的优化路径,建议通过建立综合性能源技术规范、理顺现行能源监管主体与程序规范、优化能源技术的激励机制、健全能源技术知识产权制度与创新能源技术合作机制来进一步完善与健全我国的能源技术规制。
To encourage and protect energy technology in the form of legal norms is the proper meaning of energy technology regulation.Energy technology supervision is also an important part of energy technology regulation.In the view of sustainable development,China’s energy technology progress faces the following severe challenges:carbon locking is widespread,which hinders the wide application of renewable energy technology and energy efficiency technology;most of the energy technology is high cost;the development of renewable energy industry is greatly dependent on policy support;core energy technology relies on imports;patent rights are not adequately protected and lack of clear technical regulation.Equal emphasis on precise incentives and prudential regulation is the optimization path of energy technology regulation.This paper proposes to further improve energy technology regulation in China by establishing comprehensive energy technical specifications,rationalizing current energy supervision subjects and procedural norms,optimizing the incentive mechanism of energy technology,improving the energy technology intellectual property system and innovate energy technology cooperation mechanism.
