摘要
列宁在领导苏俄十月革命和建设社会主义国家的过程中,阐述了一系列宪法治国的思想理念,并付诸于苏俄社会主义国家治理和法治建设实践。列宁认为,无产阶级的政权体现了工人阶级劳动人民的意志和利益,完全不同于资产阶级政权的本质;无产阶级革命胜利后要及时制定反映无产阶级意志的宪法,确立无产阶级政党的执政地位和政权的合法性;社会主义的宪法以根本法形式规定无产阶级国家政权机关的体系结构和权力界限;社会主义宪法要明确宣示和保障人民基本权利;要以宪法为核心建构完备的社会主义法律体系,依据宪法和法律确立苏维埃国家的治理模式和推进苏俄社会主义国家法治建设。
During the process of building a socialist country after leading Russia in achieving the victory of October Revolution, Lenin elaborated a series of ideas constitutional governance of a country and put it into the practice of the governance of Soviet Russia and the construction of rule of law in this socialist country. Lenin believed that the proletarian regime embodied the will and interests of the working class and was completely different from the essence of the bourgeois regime. After the victory of the proletarian revolution, a constitution reflecting the will of the proletariat must be formulated in time to establish the ruling position of the proletarian party and the legitimacy of its government. The socialist constitution stipulates, in the form of fundamental law, the structure and the limits of power of the proletariat government and must clearly declare and guarantee people＇s basic rights. At the same time, it is necessary to construct a complete socialist legal system with the constitution as the core, establish the governance model of the Soviet state in accordance with the Constitution and laws, and promote the socialist rule of law in Soviet Russia.
