摘要
除了脱离欧盟,英国还在蓄谋另一场脱欧:废除1998年《人权法案》,甚至脱离《欧洲人权公约》。后者除了源于反恐和维护议会主权等现实考量,也跟英国"反人权"的三种思想传统有关。其中,普通法强调权利源于习惯而成于司法救济,保守主义强调权利保护要守先待后、寓新于旧,功利主义强调权利内容取决于权衡利弊,三者共同反对"人权"说唯逻辑、认死理的特点,体现了务实内敛、妥协调和的"英国性"。
Besides exiting the European Union,UK is considering another Brexit:to repeal the Human Rights Act(HRA) or even to leave the European Convention on Human Rights( ECHR). Although the latter is triggered by practical considerations,such as anti-terrorism and the defending of parliamentary sovereignty,it has intellectual origins,that is,the three 'anti-human-rights' traditions in England. The common law argues that rights grow from customs and mellow through judicial redresses; conservatism claims that to protect rights means to conserve the settled advantages at first and let the new spring from the old; utilitarianism insists that the substance of rights depends on the calculation of utility. All of them are at odds with the logical and metaphysic character of 'human rights' ,reflecting the spirit of compromise and pragmatism,the so-called 'Englishness' .
