摘要
以往研究主要从经济学、法学、工程技术等学科视角来对制约农村土地确权因素进行分析,而忽视了制约土地确权的社会性影响因素。主要以产权的社会视角为理论解释框架,从地方性社会结构、农村特殊群体土地权属认定、历史传统、农民产权认知4个因素来分析当前土地确权面临的困境,从而更全面深入了解制约土地确权的社会性因素,为有序推动土地确权提供启示意义。
Previous researches mainly analyzed the restraining factors of rural land rights confirmation from discipline angles of economics, law and engineering, but ignored the social factors which influenced land fights confirmation. Therefore, this paper mainly took social perspective of property rights as the theory framework, analyzed the present troubles that land rights confirmation was facing from four factors including local social structure, land rights affirmation of rural special groups, historical tradition and farmer land property cognition, to build a deeper and more comprehensive understanding of the social restraining factors of rural land rights confirmation, and to provide enlightenment for promoting land rights confirmation in order.
