摘要
高校与企业合作技术创新的模式呈多样化趋势,专利法视角下的校企合作技术创新的实质是职务发明创造关系与合作发明创造关系的竞合。校企合作技术创新成果属于职务发明创造,高校与企业基于合作发明创造关系在特定的技术创新成果之上形成了专利共有关系。为激励校企合作技术创新,应强化对职务发明人取得报酬权的保护力度,充分保障高校获得合理报酬的权利,最终提升校企合作技术创新成果的转化效率。
There is a tendency of diversified technological innovation modes through university - enterprise co - operation. From the perspective of patent law, the true nature of technological innovation through university - enterprise co - operation is an integratian of in - service and co - operated invention - creations. University - enterprise innovation achievements fall within the in - service invention category, where specific co - operated invention - creations form corresponding patent co - ownerships. In order to promote university - enterprise technological innovations, measures should be taken to enforce the protection of both in - service inventors' and universities in terms of their reasonable remuneration rights, so as to enhance the transformation efficiency of university -enterprise technological innovation achievements.
