摘要
职务发明制度的完善事关我国创新驱动发展战略目标的实现。创新型国家建设考核指标与职务创新成果权利归属规则之间具有密切关系,应该建立确保雇主单位利益的创新成果权利归属规则。《职务发明条例草案(送审稿)》中有关扩大职务发明外延、提升研发资源利用率、增加发明人获得报酬情形以及引入发明报告制度等改革内容,符合创新驱动发展战略的要求。完善职务发明制度的权利归属规则应该坚持"雇主单位优先原则",并同时强化发明人实现其利益的措施,移植发明报告制度要结合我国客观情况。
Improving the regulations of service invention is important for the realization of the goal of innovation - driven devel- opment strategy of our country. And it is necessary to make right adscription rules of innovation products that can ensure the employer＇s interest, because of their close relationship with the evaluation indexes of innovative country. In the service invention bill （Draft）, there are such rules as enlarging the range of service invention, increasing the utilization rate of inventions, adding more getting - paid situations for the service inventors, and introducing invention report system, which are all complied with the requirements of the innovation - driven？ development strategy. In improving the right adscription rules of service invention, we should adhere to the principle of keeping owners＇ right at priority, and at the same time, strengthen the measures to realize the interests of the inventor. In addition, the transplantation of the foreign invention report system should be done in accordance with China＇s actual situation.
